5 Copyright Facts

1. Copyright cannot be registered in South Africa.
2. Once the work is created in a material form, the work is instantly protected by copyright.
3. The only form of copyright which can be registered in South Africa, is cinematographic films.
4. South African law does not require the use of a copyright symbol (©), although it is beneficial.
5. There is no such thing as an international copyright.

Protecting your Copyright

The best way to protect your copyright is to ensure that you have evidence of your rights in the event that your copyright is infringed. We therefore suggest the following:

1. Mark your work with your name, titles, dates & times.
2. Store electronic copies in a safe place.
3. Keep the original works hidden in a safe place.
4. Store printed copies of your work in a safe place.
5. Keep record of any agreements / e-mails / invoices pertaining to the work.
6. Use the copyright © symbol when presenting your work.
7. Register for Copyright in the USA.

Copyright is the exclusive right to control the use of a work in all the manners in which it can be exploited for personal gain or profit. This includes the exclusive right to do any of the following with the work: Copy, Publish, Perform in public, Broadcast (e.g. on radio/TV), Adapt, Translate or Let or offer for hire.

Copyright Duration

The duration of copyright in a work depends on the specific type of work. In the case of literary, musical or artistic works, copyright usually endures for 50 years after the death of the author.

Trademark Cost

The total costs of a trademark application from filing up to registration (where no opposition is filed) is between R3500.00 and R4500.00 per application, depending on the Registrar’s requirements.

The initial costs of preparing and filing a trademark application, inclusive of all fees, official expenses and VAT is:

1. First application
   R2813.00
2. Second onwards application
   R2585.00 per application

A possible trademark search will be conducted to find similar or identical trademarks. It is not compulsory for a search to be conducted in order to file a trademark application.

Copyright is different from other forms of intellectual property because a
COPYRIGHT DOES NOT HAVE TO BE REGISTERED in South Africa & UK.

In South Africa or the UK, once the work is created in a material form the creator is instantly protected by copyright and may use the copyright © symbol.

All you need to do is prove that you are the creator of the work in order to own the copyright.

We suggest the following:

1. Mark your work with titles, dates & times.
2. Store electronic copies in a safe place.
3. Keep the original works hidden in a safe place.
4. Store printed copies of your work in a safe place.
5. Keep record of any agreements / e-mails / invoices.
6. Use the copyright © symbol when presenting your work.

Copyright lasts for 50 years from the end of the year in which the work is made available to the public with the consent of the owner of the copyright; or is first published, (whichever term is the longer) but if the work is not published within 50 years after it was taken, it will last 50 years from the end of the year in which the work was published.
